Terms of Service for “Alchemist & Phial Spirit”

Welcome to Alchemist & Phial Spirit (hereinafter referred to as “the Service”), a Discord game bot developed by Goo Co., Ltd. (hereinafter referred to as “the Company”).

Before using the Service, please read these Terms of Service (hereinafter referred to as “these Terms”) carefully. By starting to use the Service (including but not limited to adding the bot to a server, entering commands, interacting with the game, or performing payment transactions), you are deemed to have read, understood, and agreed to be bound by these Terms.

Article 1: User Eligibility

  1. Age Restriction: The Service’s age limit follows the official regulations of the Discord platform. If you are under the legal age of majority, you must read and agree to these Terms accompanied by a legal guardian before using the Service.
  2. Account Authorization: The Service runs based on your Discord account. You are solely responsible for all activities conducted under your Discord account.

Article 2: Service Content and Changes

  1. Nature of the Game: The Service is a simulation game where players obtain experience, craft potions, and cultivate “Phial Spirits” through dialogue interactions.
  2. Paid Content: The Service includes free content and paid value-added services, including but not limited to Action Point (AP) refills, subscription membership plans (e.g., Bronze/Silver tiers), and developer donation items.
  3. Service Adjustments: The Company reserves the right to adjust, update, limit, or stop parts of the Service at any time based on development needs or operational strategies without separate individual notice.

Article 3: Payment and Virtual Goods Regulations

  1. Payment Platform: All payment transactions are processed through the third-party payment platform PayPal. Players agree and understand that their payment information is governed by PayPal’s Terms of Service.
  2. Nature of Virtual Goods: All virtual items in the game (such as AP, potions, materials, Phial Spirits, and membership privileges) are digital licensed services. They have no real-world monetary value and cannot be exchanged for fiat currency.
  3. Refund Policy: Due to the nature of digital content which is consumed or activated immediately upon delivery, the Company does not accept any refund requests once a payment transaction is completed, except in cases of system errors where the purchased item fails to be delivered to the account.
  4. Subscription Services: Subscription memberships (e.g., Bronze, Silver) typically have a 30-day validity period. Benefits take effect immediately after successful payment and must be manually renewed or handled according to the payment platform’s rules upon expiration.
  5. Prohibition of Real Money Trading (RMT): Selling or buying in-game virtual assets or accounts for real-world currency or property is strictly prohibited. The Company reserves the right to terminate the Service for violators.

Article 4: User Code of Conduct

Users must comply with relevant laws and Discord Community Guidelines. The Company reserves the right to suspend or terminate account permissions for the following behaviors:

  1. Automation Prohibited: Use of scripts, macros, or any third-party tools for automated operations is strictly forbidden.
  2. Exploitation of Vulnerabilities: Utilizing program errors (Bugs) or system vulnerabilities for improper gain is prohibited.
  3. System Interference: Attempting to hack, damage servers, or interfere with the normal operation of the Service.

Article 5: Data Retention and Intellectual Property

  1. Inactive Accounts: For accounts that have not been used for one consecutive year (365 days), the Company reserves the right to clear the game data of that account.
  2. Ownership: All text, artistic images, code, and virtual assets within the Service are the property of the Company.

Article 6: Disclaimer

  1. Technical Limitations: The Company is not liable for losses caused by network connection issues, Discord platform abnormalities, or force majeure factors.
  2. Data Risk: Users understand and agree to bear the potential risk of data loss inherent in a digital environment.

Article 7: Governing Law and Jurisdiction

  1. Governing Law: The interpretation and application of these Terms shall be governed by the laws of the Republic of China (Taiwan).
  2. Jurisdiction: Any disputes arising from the Service shall be submitted to the Taipei District Court as the court of first instance.
